HomeTame Terms and Conditions

These Terms and Conditions govern access to and use of HomeTame.com, HomeTame services, and related communications, bookings, or service arrangements.

1. Acceptance of Terms

HomeTame.com is operated by HomeTame LLC ("HomeTame," "we," "our," or "us"). By accessing the website, submitting a service inquiry, booking a service, or entering a service agreement, you agree to these Terms. If you do not agree, do not use the website or services.

2. Our Services

HomeTame provides home watch, property care, and related services for homeowners, property owners, and authorized representatives. Depending on availability and the service arrangement, services may include:

  • Home Watch and routine property inspections
  • Property protection, property checks, and condition reports
  • Yard and pool care coordination
  • Vendor and contractor coordination
  • Arrival preparation, cleaning, and vacation-rental preparation
  • Preventive care and on-demand property services
  • Keyholder assistance and property access coordination

3. Service Agreements and Bookings

Submitting an inquiry or requesting a quote does not automatically create a confirmed booking. A service arrangement may require written confirmation, an accepted quote, a separate service agreement, or payment. Before service begins, you may need to provide accurate property and contact information, requested services, access instructions and authorization, emergency contacts where appropriate, payment information, and other information reasonably necessary. If a separate written service agreement applies, its specific terms govern the services it covers; these Terms apply to website use and matters not otherwise addressed.

4. Customer Responsibilities

You agree to:

  • Provide accurate, complete, and current information about yourself and the property
  • Confirm that you own the property or have authority to request service and authorize entry
  • Provide accurate access instructions and promptly report changes to keys, locks, alarm codes, or permissions
  • Disclose known hazards, safety concerns, equipment problems, and relevant restrictions
  • Ensure the property is reasonably safe and accessible for authorized personnel
  • Maintain appropriate property insurance
  • Pay agreed service fees and applicable charges
  • Promptly report changes to service needs or emergency contacts

5. Property Access and Keyholder Services

When you authorize access, you authorize HomeTame and approved personnel to enter solely for the purposes and within the scope of agreed services. Access may require keys, lockbox codes, entry codes, or other arrangements. You are responsible for accurate instructions and authorization. HomeTame will take reasonable measures to safeguard entrusted keys and access information, may arrange access for approved professionals when needed, and may refuse entry if authorization is unclear, access is unsafe, or circumstances create unreasonable risk. Notify HomeTame promptly if credentials change, keys are lost, or authorization changes. HomeTame does not guarantee prevention of unauthorized entry, theft, property damage, or other incidents.

6. Home Watch and Property Inspections

Home Watch and routine property checks help identify visible conditions and maintenance concerns while you are away. Unless agreed in writing, checks are limited to the areas, items, and conditions in the service arrangement. They are not continuous, real-time surveillance; do not guarantee detection of every issue or incident; do not replace insurance, regular maintenance, or professional inspections; may not identify concealed, inaccessible, intermittent, or developing problems; and do not guarantee that a property will remain secure or undamaged. Reports and photographs reflect observations at the time of service; conditions may change afterward.

7. Security Observations and Emergency Services

HomeTame may provide agreed security-related checks, keyholder assistance, and coordination with service providers. Unless expressly agreed in a separate written agreement, HomeTame is not law enforcement, a fire department, an emergency medical provider, an alarm-monitoring center, or a guaranteed emergency-response service. HomeTame does not guarantee prevention of burglary, trespass, vandalism, or damage; continuous monitoring; immediate alarm or emergency response; or response times by authorities or third parties. If an emergency is discovered, HomeTame may take reasonable steps within the agreed scope, such as contacting you, an authorized contact, or appropriate responders. Maintain independent alarm, insurance, and emergency arrangements.

8. Vendor and Contractor Coordination

HomeTame may coordinate with cleaners, landscapers, pool-care providers, maintenance contractors, and other service providers. Unless otherwise agreed in writing, third parties perform their own specialized work and may have separate contracts, fees, and warranties. HomeTame does not guarantee third-party availability, workmanship, licensing, insurance, or performance, and is not responsible for independent third-party acts or omissions except as required by law or agreed in writing. You authorize sharing information reasonably necessary to coordinate requested services. Additional work, repairs, purchases, or expenses may require your approval.

9. Service Fees and Payments

Fees, payment schedules, deposits, and additional charges are communicated through the applicable quote, booking confirmation, or service agreement. You agree to pay fees for services you authorize. Unless otherwise specified, payment is due according to the agreed schedule; work outside the original scope may incur charges; third-party vendor charges may be separate; applicable taxes and disclosed charges are your responsibility; and payment processing may use third-party providers. HomeTame may suspend future service for overdue or disputed payments, subject to law and any service agreement. Refund, deposit, cancellation, and rescheduling terms are provided in the relevant agreement or confirmation.

10. Cancellations and Rescheduling

Contact HomeTame as soon as reasonably possible to cancel or reschedule. Fees, notice periods, refund eligibility, and rescheduling requirements are governed by the applicable service agreement or booking confirmation. HomeTame may reschedule or cancel because of severe weather, unsafe property conditions, personnel availability, equipment failure, emergencies, or circumstances beyond reasonable control. Where reasonably possible, we will notify you and work to arrange an alternative appointment.

11. Property Damage and Reporting

If personnel discover visible damage, maintenance concerns, or other conditions requiring attention, HomeTame may document the condition and notify you or your designated representative. HomeTame may take reasonable steps within the agreed scope to protect the property from further immediate damage when circumstances permit. Repairs, emergency work, or services outside scope may require authorization. You agree to provide accurate information about existing damage, known defects, and hazards. Nothing here limits rights or responsibilities that cannot legally be waived.

12. No Guarantee of Property Condition

HomeTame provides property care and Home Watch to help homeowners maintain awareness. We do not guarantee that a property will remain free from damage, theft, or unauthorized entry; that home systems will operate without failure; that external conditions will not affect the property; that every issue will be discovered; or that service will be completed without delay or interruption. Services supplement, and do not replace, the homeowner's responsibilities for ownership, insurance, maintenance, and safety.

13. Website Use

You agree to use HomeTame.com only for lawful purposes. You must not:

  • Use the website in violation of applicable laws or regulations
  • Submit false, misleading, or fraudulent information
  • Attempt unauthorized access to the website, systems, or accounts
  • Interfere with website operations or security
  • Introduce malicious software or harmful code
  • Copy, reproduce, or commercially exploit website content without authorization, except as permitted by law

14. Website Information and Availability

We make reasonable efforts to provide accurate and current information, but website content is general information and may contain errors, omissions, or outdated material. Service descriptions, availability, pricing, and geographic coverage may change without notice. We do not guarantee uninterrupted access, error-free operation, or continuous availability of every feature.

15. Intellectual Property

Unless otherwise indicated, content on HomeTame.com, including text, graphics, logos, branding, images, and website design, is owned by HomeTame LLC or used with permission. You may view and use content for personal, non-commercial purposes. You may not reproduce, distribute, modify, publish, or commercially exploit it without prior written permission, except as permitted by law.

16. Privacy

Use of HomeTame.com and its services is also governed by the Privacy Policy, which explains how personal information is collected, used, disclosed, and protected, including information about property access, service arrangements, and website activity.

17. Limitation of Liability

To the fullest extent permitted by law, HomeTame LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to website use or services, including where legally permitted loss of use, lost profits, or indirect losses from property damage, service interruptions, or third-party conduct. Nothing excludes or limits liability for fraud, gross negligence, willful misconduct, or liability that cannot legally be excluded or limited. Any additional limits or caps must be in an applicable written service agreement and comply with law.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless HomeTame LLC and its personnel from third-party claims, damages, liabilities, and reasonable expenses arising from your material breach of these Terms, lack of authority to authorize property access or services, materially inaccurate information, or unlawful conduct or misuse of the website. This does not require indemnification for HomeTame's own negligence, willful misconduct, or conduct where prohibited by law.

19. Force Majeure

HomeTame is not responsible for delays or failures caused by circumstances beyond reasonable control, including severe weather, natural disasters, fires, floods, utility outages, transportation disruptions, government actions, public emergencies, labor disruptions, or other unforeseen events. We will make reasonable efforts to communicate material service interruptions and resume services when circumstances permit.

20. Governing Law and Disputes

These Terms are subject to applicable federal and state laws. Governing law and venue for a dispute will be determined by applicable law and the relevant service agreement, considering the property's location and services provided. Nothing prevents either party from exercising rights under applicable consumer-protection laws or other non-waivable protections.

21. Changes to These Terms

HomeTame may update these Terms to reflect changes in services, business practices, website features, or legal obligations. Where required by law, we will provide additional notice or obtain consent before material changes. Updated Terms apply to future website use and service arrangements as permitted by law.

22. Severability

If a provision is determined invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with any applicable written service agreement, booking confirmation, and Privacy Policy, govern website use and services covered by those documents. If a separate written service agreement conflicts with these Terms for a particular service, that agreement's specific terms control to the extent of the conflict.

24. Terms for Professionals (Local Home Pros Network)

These terms apply to service professionals who apply to or join the HomeTame Local Home Pros network. By submitting a professional application you agree to the following:

  • Accuracy: information in your application, including trade, service areas, license, and insurance, must be true and kept current. HomeTame may decline, suspend, or remove a listing at its discretion.
  • Licensing and insurance: you are responsible for holding every license, registration, and insurance policy your trade requires, and HomeTame may ask for proof at any time.
  • Independent business: you are an independent business, not an employee, agent, or partner of HomeTame. You control your methods, schedule, staff, and tools, and you are responsible for your own taxes.
  • Listings and fees: applying is free. Approved businesses may choose a free Basic Listing or a $9.99/month Pro Listing, paid by Zelle or PayPal. HomeTame charges a 10% fee on every job it brings you, and the fee is due on each such job once it is completed and paid.
  • Your work: you are solely responsible for the quality, safety, and legality of your work and for your agreements with homeowners. HomeTame does not guarantee leads, jobs, or income.
  • Conduct and access: you must treat homeowner property and access information with care, keep it confidential, and report damage or concerns promptly.
  • Liability: to the extent permitted by law, you agree to indemnify HomeTame LLC from claims arising from your work or breach of these terms. Listing a business is not an endorsement or warranty by HomeTame.
